COMPLIANCE ISSUES and Their Impact on Wellness Strategy Employer Beware: EEOC Enforcements, ACA Impact, and Preparing for the Cadillac Tax

The Equal Employment Opportunity Commission (EEOC) has “wellness plans” on its 2015 “to-do list.” The Chicago branch of the EEOC recently filed its third lawsuit alleging that an employer-sponsored wellness program violates the Americans with Disabilities Act (ADA) and the Genetic Information Nondiscrimination Act (GINA). In filing these lawsuits, the EEOC has challenged the Affordable Care Act’s (ACA) express approval of wellness programs. In addition, employers are preparing for the upcoming Cadillac tax and wellness programs may be the best chance to implement a long term strategy to avoid the tax. In this session, attendees learn about the rules currently governing wellness programs and how future legislation and regulations may impact their programs.

Bend the Curve in Employee Health: A Multi-Level Approach at The University of New Hampshire

In February 2012, the University of New Hampshire (UNH) opened a clinic for the several thousand employees at the Durham campus. This clinic was created to address employee health and wellness and to create a low cost, high quality option for health care in the community. UNH has a strong history of engaging in the health and wellness of its students and employees. In 2008, UNH President Mark W. Huddleston charged campus constituents to address the rapidly increasing cost of health care. From this stemmed Healthy UNH, a comprehensive campus wellness program focused on making UNH the healthiest campus community in the country by 2020. Its approach goes beyond an employee-focused or student-focused wellness program, and considers the full campus population and multiple health considerations. This case study gives a detailed overview of the development of an employee clinic, challenges and successes, and lessons learned when implementing on-site employee health and wellness programs.
