Anticipating More Privacy Regulations and Enforcement in 2021 – Why You’re Exposed to Liability If You Don’t Really Know Your Organization’s Data
Like so many things that changed during the pandemic, individuals’ expectations of privacy and the regulatory appetite to enforce privacy laws, such as the GDPR, were minimal in 2020. That all began to change when California passed the CPRA (California Privacy Rights Act) in November, and many anticipate that 2021 will bring additional scrutiny, regulations, enforcement, and higher expectations of privacy programs. Virginia just passed its privacy law, at least two more states (Washington and New York) are likely to pass laws, and the European regulators and FTC – under the Biden Administration – are expected to be even more active. Whatever organizations did through 2020 needs to be reviewed; and for those organizations with privacy programs still in their in their infancy, the time to ramp up is now. Privacy programs must not be built around a certain law but should be designed to address everything across the enterprise – from HR to IT frameworks, from Marketing efforts to data collection and storage points – and more.
