In March 2013, the U.S. Supreme Court found in Kirtsaeng v. John Wiley & Sons that the First Sale Doctrine applied to text books sold with the Copyright owners' authority outside the U.S. to exhaust the copyright within the U.S. While the decision turned upon the statutory language of the Copyright Act and potentially contradictory provisions, the impact of Kirtsaeng on exhaustion of other intellectual property rights remains to be seen.
